Terms and Conditions of Use – Québec s'amuse Inc.

Introduction

This document defines the general conditions of use of the equipment (inflatable games, skill games, foam cannon, Bubble Soccer, etc.) provided by Québec s'amuse Inc. By renting or using our equipment, the customer declares to have read, understood and accepted all of these conditions.


1. Definitions

  • Client / Lessee : Any person or entity that rents or uses the equipment of Québec s'amuse Inc.
  • Inflatable games : A collection of inflatable structures and games, including skill games, foam cannons, Bubble Soccer, Gladiator, Sumo, etc.
  • Installation : The setup and removal of equipment, which can be provided by Québec s'amuse Inc. or by the client, as the case may be.
  • Fixings : The devices (such as nails, stakes, etc.) needed to anchor and secure the inflatable games.

2. General Terms of Use

  • Intended use : The equipment must be used in accordance with the instructions and intended uses.
  • Age and Weight :
    • Respect the recommended age of 12 years and under.
    • The maximum weight allowed is 180 lbs per person.
  • Ability :
    • The number of children allowed in a racing game is defined at a rate of 4 children per 20 feet of length (example: 6 children for 40 feet).
    • The number of children allowed on a slide is limited to one child per slide. Other children must wait outside the play area.
    • The number of children allowed in a jumping game is defined as 6 children.

3. Safety and Monitoring Instructions

  • Installation and Removal : The installation and removal instructions must be strictly followed.
  • Blower : The inflatable game and its blower must remain running while people are inside. It is forbidden to turn off the blower while users are present. The minimum age to operate the blower is 16 years.
  • Weather Conditions :
    • It is strictly forbidden to install or use the equipment when the wind exceeds 25 km/h or in case of bad weather.
  • General Safety Rules :
    • No food, drink or animals are allowed inside the game.
    • Shoes, jewelry, belts or any sharp objects that could injure someone or damage equipment must be removed.
    • Wrestling, pushing and shoving and somersaults are prohibited.
    • It is strictly forbidden to climb over the safety nets or to use areas not intended for access.
  • Specific instructions for Bubble Soccer :
    • Kicking another player or equipment is prohibited.
    • You should avoid deliberately aiming at an opponent's legs.
    • Participants must wear properly fastened safety harnesses and follow the instructions for using the bubble.
    • Certain protective equipment (for example, glasses or espadrilles with cleats) is regulated in order to ensure everyone's safety.

4. Customer Responsibilities

  • Monitoring :
    • A responsible adult must be present at all times to supervise the game and ensure that the rules are followed. If they must leave, the game must be deflated.
    • For structures over 40 feet, the presence of a second person on duty is required.
  • Use and Responsibility :
    • The customer is fully responsible for the equipment from the moment of taking possession until its return.
    • Any damage or incident occurring during the rental period is the responsibility of the client.
  • Fasteners :
    • The customer is responsible for finding and installing the necessary fixings to anchor the game, unless the installation is provided by Québec s'amuse Inc.
    • In this case, upon request, we can lend 12-inch nails to ensure a safe installation.
  • Insurance :
    • Québec s'amuse Inc. holds a commercial liability insurance policy covering damages arising from proven negligence on our part (for example, a defective equipment or an installation error made by our team).

      However, as certain situations are not covered by our insurance (particularly in the event of improper use, poor supervision or adverse weather conditions), it is recommended that the customer check with their own insurer that their personal liability covers the use of inflatable games or rental equipment during private events.

      This precaution aims to ensure full coverage in case of unforeseen events, and to protect all people present at the event.


5. Disclaimer and Limitation of Liability

  • Québec s'amuse Inc. cannot be held responsible for bodily accidents, property damage or injuries occurring outside of a context of proven negligence on our part.

    The client remains responsible in the event of:

    • improper use of the equipment,

    • failure to comply with safety instructions,

    • of an installation carried out by the customer without respecting the guidelines,

    • or a lack of adequate supervision.

    If you have any doubts, our team remains available to answer your questions and assist you in the safe preparation of your event.

  • Incidents related to certain specific activities: Bubble Soccer, Gladiator, Sumo or water games, are the sole responsibility of the client.
  • In case of improper use or failure to comply with instructions, the customer is fully responsible.

6. Force Majeure

  • In the event of extreme weather or any unforeseen event (force majeure), Québec s'amuse Inc. reserves the right to suspend or cancel the rental without incurring any liability.

7. Modification of the Terms and Conditions

  • Québec s'amuse Inc. reserves the right to modify these terms and conditions at any time. Modifications will be published on our website and will apply to future bookings.

8. Acceptance of Terms
  • By using our equipment, the customer confirms having read, understood and accepted all of these terms and conditions.

This document constitutes the entire agreement between the client and Québec s'amuse Inc. regarding the use of our equipment. In the event of a dispute, the applicable law will be that of the competent jurisdiction in Quebec.
